The mockery in the name of justice in the verdict of Babri Masjid demolition case was not unexpected. Ignoring all the laws and disregarding the Supreme court order, the massive structure of the Babri Masjid was publicly demolished, in front of the eyes of billions of Indian people. The first act of mockery in the name of justice had already been acted out when it took not one or two but 28 years to give a verdict in a case that took place in public. There is a popular saying defining the boundaries of bourgeois legal trial - justice delayed is justice denied. By that measure, a ‘justice’ delivered after a period of 28 years cannot be a fair justice. But, even after a long period of 28 years, the court did not even make the slightest attempt to deliver a façade of justice. For two or three years at a stretch, bloody, communal campaigns were carried out all over the country, millions of “Kar-sevaks” were mobilized by inciting extreme Hindu communalism and were subsequently used by the leaders of the Sangh Parivar to destroy a structure in front of everyone. However, the CBI and the court could not convict a single person for such act. What a wonderful judgment! All the accused have been released with 'honour'. No one was responsible for the destruction of the mosque; it was a spontaneous incident. If this is not the mockery of justice, then what else can be? Manmohan Singh Liberhan, a judge of the Liberhan Commission formed after the demolition of the Babri Masjid, also commented - the incident was not spontaneous at all, he has enough evidence that the leaders of the Sangh Parivar carried out the demolition of the Babri Masjid in a highly planned manner. He did not want to comment on whether the evidence was ignored by the court or the CBI or the evidences were not placed in front of them in the first place. Some people have commented out of disgust - no one has demolished the Babri Masjid, it has collapsed on its own!
When the Supreme Court handed over the disputed land to the trust for the Ram Janmabhoomi temple, the apex court also said that the demolition of the Babri Masjid was a criminal act. Many bourgeois observers then tried to convince us by pointing towards this part of the judgment that the Supreme Court had considered both the contending sides. Now we do not know in which part of the verdict they will seek balance. The CBI and the court probably did not leave any road open for them. With these two verdicts, the Indian judiciary is unveiling its cover of apparent neutrality and declaring who they really stand for.
However, the real significance of this verdict is not that those responsible for the Babri Masjid demolition, which the Supreme Court had declared as a criminal act, were not punished. The real significance of this verdict lies in the fact that this verdict proves how far the fascist campaign of the Sangh Parivar has advanced, where they have almost completed their domination over different organs of the state, including the judiciary. The goal of this fascist campaign of the Sangh Parivar was not just to demolish the Babri Masjid and build a Ram Janmabhoomi temple, it never was. It is only one of the pretexts to stir up communal sectarian tensions among the majority of the Hindu population and subsequently lead the country towards a Hindu state by creating communal divisions across the country. The goal of this fascist Hindu state is not only to turn minorities into second-class citizens, but to deprive all the oppressed people of the slightest degree of democracy and turn India into a state where democracy will not exist at all. From the economic standpoint, the bourgeoisie and the rural exploiters under the leadership of the big bourgeoise will have the reign of indiscriminate exploitation and from the social viewpoint, the upper caste Hindus of the Hindi belt will dominate, while the rest will be under their feet. The danger in front of the working class including all toiling masses is that the Sangh Parivar and the BJP are in fact defending the interests of the big bourgeoisie, who are dependent on the imperialists. To represent and defend their interests the Sangh Parivar has and will continue to unleash its attack on the working class. In doing so, the BJP has used its fascist power to attack the working class and the people more aggressively than other political representatives of the ruling class. No matter how much they oppose on paper, in reality, all the established political parties have, even though not directly, but indirectly supported them in this campaign. They have neither have the ability nor the will to stop the fascist march of the Sangh Parivar. They will at the most try to use the people's protests against the BJP to assume political power. The fascist onslaught of the Sangh Parivar must be stopped by the working class, by organizing all the toiling masses. This power is perhaps not visible yet. But only the working class has that power. Instead of awakening the independent power of the working class, the so-called communist reformist parties turned the class into followers of the petty-bourgeois leadership of their party. As a result of the betrayal of that leadership, the working class is now disintegrated. Now, the working class itself has to arouse and awake its independent power, by which it will not only resist the campaign of fascism but will also lead the society on the path of liberation from exploitation. The verdict of Babri Masjid conveys this call to the advanced proletariat - wake up, arise quickly, unite yourselves, organize all the workers, prepare yourself to face this campaign of fascism.
